Purpose and Legal Basis

The Data Controller carries out the activity of creating websites for companies, brand identity, logo creation, e-commerce, and social media strategies. This website does not track or collect user data. There is a contact email that allows interested parties to communicate directly with the Data Controller. The data transmitted via email are not automatically stored in databases and no cookie data is detected on users' computers. The optional, explicit and voluntary sending by filling out the contact form involves the subsequent acquisition of the sender's email address, necessary to respond to requests, and any other personal data optionally entered by the interested party. Explicit consent to data processing is not required, as there is a legitimate interest of the Data Controller to use the information voluntarily provided by the interested party to respond to requests, issue estimates, formulate contract proposals, fulfill legal obligations, and exercise the rights of the Data Controller, such as the right to defense in court.

Duration of Treatment

Except for the retention period provided for by specific regulations (e.g. tax, anti-money laundering, etc.), for the entire duration of the contract and for the entire duration of any dispute, the Data Controller retains the data collected for a maximum period of 3 (three) years from the end of the relationship with the Interested Parties, in order to be able to respond to any requests from the same.

Treatment Methods

The processing is carried out within the limits strictly necessary to achieve the purposes set out above, in compliance with the principle of proportionality in the choice of recovery and storage methods and with the adoption of all appropriate measures to guarantee the security and confidentiality of the personal data of the interested parties.

Where is the Collected Data Located?

The data is processed and stored at the Data Controller's headquarters and on the company tools used (e.g. computers). All data (paper and digital) are protected by adequate security systems to guarantee their confidentiality and protection. All data is physically stored in Italy. Some digital files may be stored in cloud systems located within the European Union, with selected suppliers to guarantee the security and confidentiality of the data.

Data Hosting Locations

Outofmind.best uses shopify which dynamically reorders storage across multiple Google Cloud Platform regions, ensuring a reliable and scalable infrastructure that can handle unpredictable volumes across the entire merchant database. To ensure our services, we need to be able to transfer data geographically and have implemented measures to comply with applicable laws and regulations, including GDPR.

Shopify now stores some personal data about merchants and customers in Europe (i.e. the EEA, UK, and/or Switzerland), as follows:

  • New merchants in Europe automatically take advantage of this new infrastructure and now have their store data, order data, and customer personal data stored at rest in Europe by default.
  • All existing Shopify features will continue to work.
  • Even if merchants' customers' personal data is stored in Europe, we will rely on international data transfers for the processing of personal data.
Data Communication

The data are not subject to communication and dissemination to third parties, except for obligations arising from the law. In compliance with these obligations, customer data may be transmitted to third parties who carry out the processing on behalf of the Data Controller in their capacity as external Data Processors appointed pursuant to art. 28 GDPR. For example, this may include the accountant for data relating to invoicing, Credit Institutions, employees and/or collaborators of the Data Controller in the performance of their normal work and/or collaboration activities, as persons authorised to process. The updated list of these parties is available at the offices of the Data Controller.

Rights of the interested parties (Articles 15 and following of the GDPR)

The requests referred to in the previous Art. 7 may be submitted by the Interested Parties to the Data Controller by registered letter or PEC (Certified Electronic Mail) to the addresses indicated in the previous Art. 1. In all cases, the interested parties must attach a valid identity document to the request.
